I went to the DIA presentations, so although I'm not a lawyer I have listened carefully.
The new NZ legislation does not need explicit consent - it will operate with implicit consent. It also only triggers for "commercial" emails, which this list is not :-)
Sorry I should have said that 'good business approach' is explicit and then you don't have to worry about commercial or not. It was pointed out on another list that having a URL listed in your email sig could deem a message to be commercial if that site relates to the content of the message.
