I believe that you have provided the answer to your own question, here. They're not providing you with the services you have contracted for, which if I were you, would be pretty much a dealbreaker. :) I presume you've brought this to the attention of your account manager, as well as actually logging it as a technical fault?
People have mentioned moving DC's or bandwidth providers, however who on the shore can provide cheap layer2 to sky tower;
I'm currently contracting for Maxnet to wrangle bits for them. They have an excellent data center[1] in Albany, and can provide you with a vlan (or multiple vlans) to the Sky Tower along with all the usual Internet and colocation services. So, like, there's at least one place, and I'm sure there's others that can help you out as well. Naturally you don't have to come to where I work, or connect to the network I run[2], but you certainly also don't have to stay where you are if they're not providing you with the service you're paying for.
