IIRC, the process is outlined somewhere on the ComCom Web site but before going ahead with the application, note that the fee is steep -- $22,500. The process also takes a long time, up to a year, and while the Commission mulls over submissions from "interested parties", a provider cannot resell UBS. For smaller providers, I'd venture to guess that the above means it's pretty much impossible to apply for determination. Note that indications are that the only variable factor for UBS is the downstream speed. That's as much as I've got out of the ComCom -- latency and other service factors aren't likely to be regulated. And the upstream is as we know fixed to 128kbit/s in law... -- Juha
