An FBI agent demonstrated that at NANOG 21 in DC a while back. That was how it worked then, although the agent who gave the presentation said they had other versions in the pipeline. Most of their effort seemed to have gone into building a filter front-end that you could configure directly from a court order; he went to some pains to indicate how the system was designed to let agents view only traffic that the court said you could view, and nothing else. Of course, it would have been surprising if there was any different emphasis. Innuendo on the NANOG list seems to suggest that ISPs playing host to such devices are not permitted to reveal their presence, and that asking the question "does anybody have these things installed" is unlikely to yield useful answers.
