There's no way anyone's privacy could be compromised just by counting packets. I don' agree. From what I have read I currently think that what WAND is doing is unacceptable with out informed concent from anyone involved in the research.
However, capturing header + payload and disseminating it to a third party without a warrant is ILLEGAL.
