Don't most ISPs have terms and conditions that state they may monitor, record, and intercept traffic on their network for their purposes as required? If you're an ISP and you don't, you may want to talk to your legal consultants about including this... for doing this sort of research, or even using any kind of flow exports, DPI, etc. aj [I think this has gone OT enough from Nathan's original request.]
