This law will hold ISPs liable for delays in e-mail delivery even when the delays are associated with a remote network over which the ISP has no control. I believe that at this point we start talking of concerted information campaigns aimed at those wonderful employees of ours, to get this particular section of the law ammended or removed.

InternetNZ (or more specifically its Vice-President Rick Shera) noticed a few days ago the possible ramifications of the law where ISPs can be caught in the middle between telcos and customers. Rick has put in a submission to the select cmte. ISPs and others could ask the Cmte Clerk if they can put in a late submission (they were due in by 15th). The Clerk is Marie Alexander, e-mail: SC-Commerce(a)parliament.govt.nz and phone: 64 4 471 9532. InternetNZ will make an oral submission on the bill also. Possibly an interested ISP could ask to be part of the delegation (adds credibility to have actual ISP there). Any examples etc of how this will unfairly penalise ISPs for things not under their control could forward such material onto Rick or Sue Leader.
