I also had someone contact me asking what can be done about this guy.

As one can see he seems to have sent this one through a Brazilian ISP
which may not be too responsive to spam complaints from NZers.
Simon alluded to a police contact on this guy - is this related to
spamming or other activities? The reason I am asking is the issue of
how to stop him if the Brazilian ISP is unco-operative.
His e-mail database is almost certainly a breach of the Privacy Act.
However a complaint can take 12 - 18 months to resolve. Do people
feel there would be merit in having a formal complaint filed just so
one can get "case law" on the books??
Another issue is whether we should lobby Parliament for specific
statute law banning spam? Up until now I have not thought it is
necessary as every ISP I know of in NZ (possible exception of
world-net?) bans spammers, but if NZers have easy access to overseas
ISPs then maybe it is worthwhile? Opinions welcome.

I too have had the matter raised with me. I'll go back to complainant and tell them this although by then he'll probably have moved on.

Does anyone know how effective the US laws banning junk faxes and spam are? If there's a model that actually works I'd be more happy to support it's introduction than if we have to start from the ground up. As an update on this I am helping facilitate a formal complaint to the Privacy Commissioner on this issue, for two reasons: 1) To help put a nail into this particular individual 2) To get a formal legal ruling that spamming of this type is illegal under the Privacy Act. It is likely the formal complaint will be laid next week and we may alert some media to this. If anyone knows of (or is themself) someone who received this e-mail and would be keen to add their name to a joint complaint please let me know. (Just checked with accounts on some details and what we can release) There were a couple of issues that got the police involved. One was they fact that one of his accounts was created by a young friend of his ( in the friends name) and after Julian used it and the account was closed the Parents of the friend were not very happy getting the bill. The other was one of his early spams was (from memory) a standard ponzi scheme. Owen Key with the Police in Auckland was helping (and somebody in Wellington), I have heard he may have left the force since then however.
