Hi Joe, [snip] IX Australia are the only independent Internet Exchange operator in Australasia, with 16 years experience running exchanges throughout the region. Unlike all other Internet Exchanges in the region, we are not for profit, and seek to serve our members, not our shareholders. We're already very far down the path of bringing some very interesting content providers and large NSPs online. [/snip] Interesting to see IX-Australia following Megaport lead again and it¹s great to see competition. However, a few points regarding your statement above: 1. It is a misrepresentation to say that WAIA/IX-Australia is the only independent provider of IX Services in Australasia 2. Its generally known that IX-Australia provides services to organisations that aren¹t members of WAIA/IX-Australia. which apart from a contravention of its constitution means the statement above isn¹t quite factually correct. Can you confirm WAIA only provide services to registered members under its constitution? I can think of a handful that aren¹t. 3. The constitution of WAIA only provides for WAIA/IX Australia to service Australia, so I¹m not sure whether the announcement is simply a reaction to Megaports announcement, not approved by members/amended in the constitution or part of a plan to expand (not foreshadowed at the recent AGM which would have been the time to amend the constitution?) 4. WAIA is Incorporated in WA which actually only really provides for the delivery of services in Western Australia (there is a pathway to delivering nationally through Incorporation under ASIC), but certainly is not able to provide services outside of Australia. Operation outside of Australia may lead to issues regarding WAIA¹s incorporated status. Despite some persistent rumours that IX-Australia is perhaps being taken advantage of by a particular commercial carrier to hinder Megaports success, I would like to think otherwise, but this reaction to step outside the legal operational jurisdiction makes me think there is merit to same. So ultimately, from a Network Operations perspective it would be helpful to understand whether WAIA as an Incorporated Association in Western Australia is legally able to operate outside of Australia in the first instance though (even if the Constitution allowed it which I don¹t think it does). Your clarification to the list would be helpful. Cheers [b] WAIA 2013 Constitution https://www.waia.asn.au/node/83
Hi Bevan,
Yes, Joe changed the word Australia to Australasia without realising
how that changed the claim. He is guilty of exuberance. Good catch!
We will be sure to send him to the naughty corner for a half hour to
consider the upset he caused.
This list is not the proper forum for your other questions and I'd
encourage you to ask your questions off-list. We wouldn't want anyone
to think this was an attempt to discredit a competitor.
You have piqued my interest about the 'particular commercial carrier'
you think is taking advantage of us. Any insight about who this might
be would be humbly received.
We are, after all, just a bunch of people working hard to make our
little bit of the internet a better place by spreading the love of
peering wherever we are asked to go by members.
Certainly a noble task that is not motivated by profit seeking.
Kind regards
Petar Nikolich
WAIA Executive
P.S. Full Disclosure - Bevan once bought me a drink at Ausnog in case anyone
cares :-)

Hi Petar, I thought I would wait a few days before responding. I¹ll leave WAIA¹s decision to extend outside of Australia and its potential impact for your members. But I would just like to correct the following statement.

Full Disclosure: I¹m pretty sure you are aware I bought WAIA a lot more than a drink, but in case you aren¹t. In 2011/12 when TPG/PIPE started going a bit ferrel WAIA/IX Australia was considering expanding, WAIA needed some help to get established on the East Coast. I (through my companies) helped Joe and WAIA assistance with getting established: - Free racks for WAIA¹s an extended period of time in M1 (Melbourne) and B1 (Brisbane) data centres (which I think also happened in S1) - Some reduced cross-connects (think some were free) to establish peers under trial - I personally emailed dozens of key NEXTDC clients and strategic industry contacts to introduce Joe and WAIA/IX-Australia to hopefully get them on board (which many did) - Invited Joe to our industry events to meet our key clients in these markets My relationship with WAIA goes back over a decade. Despite PIPE¹s leadership position in peering and a pretty good fibre footprint in Perth along with all the switch and router equipment necessary already installed (PIPE offered other ethernet services), PIPE never launched peering into W.A. That maybe something you should speak to the previous WAIA Executive about. Bit disappointing that history is trying to be re-written, but such is life. Anyway all the best. Cheers [b]
Hello again Bevan, Quick recap.
P.S. Full Disclosure - Bevan once bought me a drink at Ausnog in case anyone cares :-)
The statement didn't need correcting because it was correct.
Thanks again for the drink you bought >> ME <<
On a more serious note; there is room in Australia for not-for-profit and
commercial peering to co-exist and we sincerely hope to contribute
to/encourage the same in NZ.
We also love and appreciate everyone that has helped WAIA grow by donating
their time, space, power, commercial discount, wisdom, contacts or best
wishes.
This includes you, Bevan.
Nothing more to see here - lets move along before our Kiwi hosts kick us out
:-)
Kindest regards
Petar Nikolich
WAIA Exec
P.S. My buy for a drink when next we meet :-)

Hi Bevan,
Im almost certain that the legal status of IXA (company, evil corporate,
not-for-profit, otherwise) is of little to no consequence given that this
list concerns operational matters.
But thanks for your thoughts. Perhaps a one pager from the various IXs
themselves on how their ideologies would compell people to participate.
(Not emailed just subtly linked)
Cheers
