Yep ! Had calls dribbling in here all morning ...
The DNC is aware and I'm sure things will be taken up by her.

The physical address they have in the same building as us, two floors up. Its a 'virtual office' so theirs no one actually here, and information is emailed to an Australian e-mail address by the receptionists, so beating down someone's doors not going to work.

I really like the "please return this section with you [sic] payment" line as well.. just smacks of professionalism.
On the web page and I quote "Need some more information? Have a query you want answered? If so, use our support section to answer frequently asked questions (FAQ's). To talk to a friendly voice call 09 353 1481." Bet that guy wont be to friendly for long. I had not been following this issue last time it happened but what was the outcome from the DNC ? I had not been following this issue last time it happened but what was the outcome from the DNC ?
The DNC are warning people to stay away
http://dnc.org.nz/story/30143-29-1.html
there's probably not much else they can do.
The Commerce Commission:
Aug 2003
"In the meantime, the Commission will continue to look into this issue."
http://www.comcom.govt.nz/publications/display_mr.cfm?mr_id=1219
Oct 2003
"The Commerce Commission has formally warned Australian company
Domain Names NZ ..."
http://www.comcom.govt.nz/publications/display_mr.cfm?mr_id=1252
This is wet bus ticket stuff, basically nothing is being done about
those people which is why they are doing it for the third time now.

The issue has been covered extensively in the media here and Australia as well, and the company and individual running it are currently being taken to court by the ACCC and AuDA across the ditch. If I understand it right, NZ's relatively open economy means you don't need anything in particular to trade here. No licence/permit, or physical presence even, thanks to the Internet and cheap phone and mail redirection services. Why anyone would want to deal with such an entity is beyond me, however. -- Juha

And what do you propose should be done with a company that does not operate in NZ other than a phone number that is either a msg service or a toll free number with a ACD type prompt on it I blogged it today with a link to the number (http://www.nznews.org.nz/2003/10/30.html) which is 0800 15 88 33 and fax 0800 15 66 33 In my opinion it is just more of the many scum aussie operators that just extend thier scams to include NZ. Was just informed that the AuDA and ACCC court proceedings against Domain Names Pty Ltd will be heard on the 19th of next month. -- Juha
Re: Domain Names NZ scam
Just wondering is anyone on this list a lawyer
I just got my second mail from these bastards. It's made out just like an
invoice telling me to register my domain.net.nz
Unauthorized use of the domain name registry for commercial solicitation
perhaps ?
New Zealand Privacy law perhaps ?
Is there anything like class action lawsuits in New Zealand and Australia?

Tikiri, I would encourage you to register a formal complaint with the Commerce Commission, even though it may seem pointless. The greater the number of squeaky wheels, etc. The AuDA has started a class action against Domain Names Australia Pty Ltd, the company that is trading in NZ as Domain Names NZ. It does seem a bit odd that the CER allows for scamming across both sides of the Tasman but no legal redress for Kiwis being taken for a ride by Aussie rogues. -- Juha Saarinen
Can only add to Juha's comments. As a registrar, we are pretty fed up with Mr Rafferty and co. Best action as far as we can gather is strong complaints to NZ comcom, with a request they pursue this with Aussie equiv ACCC. Also cc to dnc(a)dnc.org.nz Both the ACCC and AUDA are taking court action against this crowd, I think mid Nov date is set.
