This message had no confidential statement attached, so one assumes that
it's open and can be distributed to the recipient wanted to.
I hear actually on the Radio this morning that TelstraClear is off to
the Commerce Commission.
It will be good to track the outcome of that..

Can Someone please enlighten me as to how one would do this ? Beacuse I have called the comissioners office 3 times and emailed 3 times to ask how to "apply to the commission" and not even had the decency of a return phone call. No wonder the comission thinks that the ISP's must be happy, they only listen to lawyers over drinks at Bellamy's as far as I can tell.

IIRC, the process is outlined somewhere on the ComCom Web site but before going ahead with the application, note that the fee is steep -- $22,500. The process also takes a long time, up to a year, and while the Commission mulls over submissions from "interested parties", a provider cannot resell UBS. For smaller providers, I'd venture to guess that the above means it's pretty much impossible to apply for determination. Note that indications are that the only variable factor for UBS is the downstream speed. That's as much as I've got out of the ComCom -- latency and other service factors aren't likely to be regulated. And the upstream is as we know fixed to 128kbit/s in law... -- Juha
